DUI Georgia Second Offense

When determining the sentence for a DUI Georgia second offense, the judge must go by the court’s mandatory minimum guidelines. For a second offense this can mean at least 72 hours in jail, though you may be sentenced to at least a week behind bars. You could be ordered to pay $600 to $1000 in jail (in addition to surcharges), as well as perform community service and complete a DUI risk reduction program. An alcohol assessment may be required, and, you could be ordered to complete an alcohol treatment program if it is recommended following the assessment.
The probation period for a DUI Georgia second offense is 12 months; however, the amount of time served in jail will be subtracted from this number. While on probation, you will be required to obey the conditions and terms set forth by the court and will face serious consequences if you fail to abide by them.
The license suspension for a second offense is three years. For the first year, you will be unable to drive at all—this is known as a “hard suspension.” After this time, you may be eligible to drive provided you have an ignition interlock device installed for six months. While you are on a hard suspension, you must surrender your license plates to the court. If another family member depends on your vehicle for transportation, a hardship application may be filed.
One of the most embarrassing punishments that second offenders face is having their photo, name, address, and details of the arrest published in their local newspaper—and this cost comes out of your own pocket!
